By participating in the Tyger Auto affiliate program ("Tyger Pack Affiliates"), you ("Affiliate") agree to be bound by these Terms of Service. Please read these terms carefully before enrolling.
1. Relationship Between Parties
Independent Contractor Status: The relationship between you (the "Affiliate") and Tyger Auto is that of independent contractors. Nothing in this agreement shall be construed to create a partnership, joint venture, agency, employment, or franchise relationship between the parties.
You acknowledge and agree that:
- You are not an employee, agent, or authorized representative of Tyger Auto
- You have no authority to bind Tyger Auto to any contract or obligation
- You are solely responsible for your own business expenses, taxes, and insurance
- You will not represent yourself as an employee or official representative of Tyger Auto
- Tyger Auto exercises no control over the manner, means, or methods by which you promote products, provided such promotion complies with this agreement
- You are free to promote other companies' products and services, including competitors
This independent contractor relationship means Tyger Auto will not provide employee benefits, withhold taxes, or provide workers' compensation coverage.
2. Commission Structure
Tiered Commission Rates:
- Tyger Cub (Tier 1): 8% commission (all new affiliates)
- Future Tiers: To be determined
Commission Calculation: Commissions are calculated on the net sale amount (product price minus returns, refunds, and cancellations). Shipping charges, taxes, and fees are excluded from commission calculations.
Session-Based Tracking: When a customer clicks your unique affiliate link, a tracking cookie is placed on their browser for the duration of their shopping session. If the customer makes a purchase during that same session, you will receive commission on that sale. The cookie expires when the customer closes their browser or the session ends. Last-click attribution applies—the most recent affiliate link clicked during the session receives credit.
3. Payment Terms
Payment Schedule: Commissions are paid monthly within 60 days following the end of each calendar month, provided your account balance meets the minimum payout threshold of $100. If your balance is below $100, it will roll over to the next month until the threshold is met.
Payment Method: Payments will be issued via PayPal. You are responsible for providing accurate payment information and notifying Tyger Auto of any changes.
Returns & Chargebacks: If a customer returns a product or initiates a chargeback, the corresponding commission will be deducted from your account balance. We reserve the right to hold commissions for 60 days to account for potential returns and chargebacks.
Account Termination: Upon termination of your affiliate account (by either party), any earned commissions above the minimum threshold will be paid out within 60 days, minus any outstanding returns or chargebacks. Commissions on orders placed after termination will not be honored.
4. Tax Responsibility
You are solely responsible for any and all taxes associated with commissions earned through the Tyger Pack Affiliates program. If you receive $600 or more annually, you will receive a tax form (1099-K from our payment processor or 1099-NEC from TygerAuto, depending on payment method). You may be required to provide tax documentation such as a W-9 form upon request. International affiliates are responsible for compliance with their local tax laws.
5. Promotional Guidelines & Restrictions
Permitted Activities:
- Sharing your unique affiliate link on social media platforms (YouTube, Instagram, TikTok, Facebook, etc.)
- Including affiliate links in blog posts, articles, and reviews
- Promoting through email to your own subscribers (no purchased lists)
- Using affiliate links in online forums where permitted by forum rules
- Creating original content featuring Tyger Auto products
Prohibited Activities:
- Bidding on Tyger Auto branded keywords or variations in paid search campaigns (Google Ads, Bing Ads, etc.)
- Using misleading, deceptive, or false advertising
- Sending unsolicited spam emails or messages
- Misrepresenting your relationship with Tyger Auto (claiming to be an employee, official representative, etc.)
- Cookie stuffing, fake traffic generation, or fraudulent click activity
- Self-referral purchases or encouraging friends/family to make purchases solely for commission
- Modifying, cloaking, or redirecting affiliate links in ways that obscure tracking
- Using Tyger Auto trademarks or copyrighted materials without permission
- Making false or unsubstantiated claims about product performance
- Violating FTC guidelines or failing to disclose affiliate relationships (must use "#ad", "affiliate link", or similar disclosures)
6. Compliance with Laws
FTC Disclosure Requirements: You must comply with all Federal Trade Commission (FTC) guidelines regarding endorsements and testimonials. This includes clearly and conspicuously disclosing your affiliate relationship with Tyger Auto in all promotional content. Acceptable disclosures include "#ad", "#affiliate", "affiliate link", or similar clear language.
Product Claims: All promotional content must be truthful and not misleading. You may not make false claims about product features, benefits, or performance. Any testimonials or reviews must reflect your genuine experience with the products.
Applicable Laws: You agree to comply with all applicable federal, state, provincial, and local laws and regulations in connection with your promotional activities.
7. Intellectual Property
Limited License: Tyger Auto grants you a limited, non-exclusive, revocable license to use Tyger Auto trademarks, logos, and product images solely for the purpose of promoting Tyger Auto products through the affiliate program. This license terminates immediately upon termination of your affiliate account.
Restrictions: You may not alter Tyger Auto's trademarks or logos, use them in a manner that suggests endorsement or partnership beyond the affiliate relationship, or register domain names containing Tyger Auto trademarks.
8. Violations & Remedies
Breach of Terms: Violation of any terms set forth in this agreement, including but not limited to fraudulent activity, prohibited promotional methods, or misrepresentation, constitutes a material breach and will result in:
- Immediate account termination and revocation of affiliate privileges
- Forfeiture of all unpaid commissions, regardless of amount or pending status
- Liability for damages incurred by Tyger Auto as a result of your breach, including but not limited to:
- Brand damage and reputational harm
- Customer service costs related to misleading promotions
- Legal fees and costs associated with enforcing this agreement
- Chargebacks, refunds, or returns directly attributable to your violation
- Lost business opportunities or revenue
- Costs to investigate and remediate fraudulent activity
Right to Pursue Damages: Tyger Auto reserves the right to pursue full legal remedies for any damages exceeding forfeited commissions. The forfeiture of unpaid commissions does not constitute a limitation or waiver of Tyger Auto's right to seek additional compensation for damages caused by your breach.
Clawback Provision: Tyger Auto reserves the right to recover previously paid commissions if violations are discovered after payment, including pursuing collection through legal means if necessary.
9. Liability & Indemnification
Liability Disclaimer: Tyger Auto is not responsible for any claims, damages, or liabilities arising from your promotional activities.
Indemnification: You agree to indemnify, defend, and hold harmless Tyger Auto, its parent company, subsidiaries, affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, investigations, liabilities, judgments, fines, penalties, settlements, interest, and expenses (including attorneys' fees) that directly or indirectly arise from or are related to:
- Your breach of this agreement
- Your promotional activities and content
- Any misrepresentation made by you
- Your violation of any laws or regulations
- Any third-party claims arising from your participation in the affiliate program
10. Link Integrity & Fraud Prevention
Tracking Requirements: Affiliates may not modify, cloak, or redirect affiliate links in ways that obscure tracking or violate these terms. All affiliate links must direct customers to Tyger Auto.com without intermediate redirects (except through approved link shorteners like bit.ly).
Fraud Prevention: Fraudulent activity, including but not limited to cookie stuffing, fake traffic, bot-generated clicks, incentivized clicks, or self-referral purchases, will result in immediate termination and potential legal action.
Monitoring: Tyger Auto reserves the right to monitor affiliate activity, investigate suspicious patterns, and request documentation of promotional methods at any time.
11. Program Modifications & Termination
Modification Rights: Tyger Auto reserves the right to modify commission rates, payment terms, tracking methods, or any other aspect of the affiliate program at any time with 30 days written notice. Changes to commission structure will not apply retroactively to existing pending commissions.
Termination by Tyger Auto: Tyger Auto may terminate your affiliate account at any time, with or without cause, with 30 days written notice. In cases of breach or fraudulent activity, termination may be immediate without notice.
Termination by Affiliate: You may terminate your participation in the affiliate program at any time by providing written notice to Tyger Auto. Upon termination, you must immediately cease all use of Tyger Auto trademarks, logos, and promotional materials.
Effect of Termination: Upon termination, your affiliate links will be deactivated, and you will no longer earn commissions on new sales. Pending commissions (subject to return/chargeback holds) will be paid according to the payment schedule outlined in Section 3.
12. Confidentiality
You agree to keep confidential any non-public information about the affiliate program, including but not limited to commission structures for other affiliates, internal communications, and proprietary business information. This obligation survives termination of this agreement.
13. Dispute Resolution & Governing Law
Governing Law: This agreement is governed by the laws of Washington State, USA without regard to its conflict of law provisions.
Dispute Resolution: Any disputes arising from this agreement shall first be attempted to be resolved through good faith negotiation. If negotiation fails, disputes will be resolved through binding arbitration in Bellingham, Washington in accordance with the rules of the American Arbitration Association (or applicable arbitration body).
Jurisdiction: To the extent arbitration does not apply, you agree to submit to the exclusive jurisdiction of the courts located in Bellingham, Washington for resolution of any disputes.
14. General Provisions
Entire Agreement: This agreement constitutes the entire agreement between you and Tyger Auto regarding the affiliate program and supersedes all prior agreements and understandings.
Severability: If any provision of this agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
No Waiver: The failure of Tyger Auto to enforce any right or provision in this agreement shall not constitute a waiver of such right or provision.
Assignment: You may not assign or transfer your rights or obligations under this agreement without Tyger Auto's prior written consent. Tyger Auto may assign this agreement without restriction.
Amendments: Tyger Auto reserves the right to amend these terms at any time. Continued participation in the affiliate program after changes are posted constitutes acceptance of the modified terms.
